Terms of Use – DARIA Website
Please read these Terms of Use carefully before using the website.
Welcome to the DARIA website (the “Website”). The Website is an e-commerce platform that allows users to browse, order, and purchase wigs and related products (collectively, the “Service”).
Acceptance of the Terms of Use
1.1. Use of the Website, its content, and the products displayed on it is subject to these Terms of Use (“Terms of Use”). Any reference to the “Website” also applies to the official Instagram account: @daria_wigs. Any use of the Website, including checking the consent box at checkout and completing an order, constitutes your agreement to these Terms of Use and to the Website’s Privacy Policy. If you do not agree to these Terms of Use, in whole or in part, you are not permitted to use this Website for any purpose. The Website reserves the right to update these Terms of Use from time to time.
1.2. Use of the Website and the services offered is permitted for lawful purposes only, and only for users over 18 years of age who are legally competent to enter binding agreements.
1.3. The Terms of Use are written in the feminine form for convenience but apply equally to all genders.
User Obligations
2.1. It is strictly prohibited to make wholesale purchases and/or any commercial use of the Website’s content or products unless prior written approval is obtained from the Website.
2.2. To ensure proper, safe, and optimal operation of the Website, you are strictly prohibited from engaging in the following actions:
2.3. Browsing, scanning, or using the Website through software designed to collect information or perform actions that mimic normal user behavior, including bots or crawlers.
2.4. Manipulating URL addresses to access internal pages that are not intended for direct access (URL hacking).
2.5. Performing any action that constitutes a violation of the law, including uploading or publishing content that infringes copyrights, trademarks, or trade secrets; posting defamation, obscene material, or violating another’s privacy.
2.6. Performing any action regarding the Website’s design, source code, elements, or content that is reserved exclusively for the copyright owner under the Copyright Law (2007), contrary to this agreement.
2.7. Interfering in any way with the Website’s operation.
2.8. The Website may block any user’s access at its full discretion, whether due to violation of these terms or due to any action or omission that harms the Website or a third party.
Product Information
3.1. All wigs sold on the Website are classified as goods manufactured according to the customer’s measurements, requirements, or selections (such as hair length, size, model, special requests, etc.). Therefore, they are considered custom-made products. This classification is essential for Section 7 (“Cancellations and Returns”).
3.2. The Website offers, among other things, catalog wigs (“Home Collection”, “Special Designs”), as well as custom-made wigs. In all cases, products are supplied only upon order and are created and/or tailored individually according to the client’s selections, including adjustments, finishing, and quality control prior to delivery. There is no guarantee of immediate availability.
3.3. Labeling an item as “Out of Stock” indicates that the product is not available for immediate supply and may require additional production time or may be unavailable entirely. This designation is for linguistic convenience only and does not imply that any product on the Website is pre-manufactured. All wigs remain custom-made or custom-finished products. DARIA reserves the right to update availability or specifications at any time.
3.4. The Website strives for maximum accuracy in descriptions and media; however, due to the natural qualities of human hair, reasonable variations may occur in color, texture, density, volume, and more, as well as display differences across screens and lighting conditions. Such variations do not constitute a defect. Images are for illustration only.
3.5. Production or tailoring of the product will be completed in accordance with the measurements and selections provided by the customer. Any mismatch resulting from inaccurate measurements or selections will not be considered a defect.
3.6. On the “Now in Stock” page, wigs are offered from existing inventory. For these items, returns or refunds may be available under the conditions outlined in the “Returns and Exchanges” section.
Purchasing on the Website
4.1. Purchases may be made by adding items to the shopping cart and completing an order form including identifying details, address, phone number, and payment information.
4.2. For certain products, such as wigs, an order confirmation message will be sent after the order is placed. The transaction is subject to approval by the company. Only upon approval will an official transaction confirmation be sent, or alternatively, a notice of non-approval.
4.3. DARIA reserves the right to refuse a transaction for any reason, including unavailability of the item or inability to supply it.
4.4. Product images on the Website are for illustration only. Actual products may vary.
4.5. At checkout, you will be required to confirm your order details, select a payment method (credit card, PayPal, Bit, or any payment option approved on the Website), and provide the information required for payment processing. Payments are processed through secure third-party gateways. Payment information is entered directly into the payment provider’s system and is not stored on the Website. The use of your information for payment processing is subject to the payment provider’s Privacy Policy and Terms of Service.
4.6. After submitting your payment details and receiving transaction approval, a confirmation message will be sent. DARIA may decline orders at its discretion; in such cases, no charge will be made. If incorrect payment details are provided or the payment provider declines the transaction, an appropriate notice will be sent and the order will not take effect.
Taxes, Customs, Clearance Fees & Import Responsibility
5.1. Orders placed on the Website are shipped directly from the manufacturing facility to the customer. For direct-to-consumer shipments from an overseas supplier, the customer becomes the registered importer and is solely responsible for all import taxes and regulatory requirements.
5.2. Product prices displayed on the Website do not include import taxes, VAT at import, customs duties, purchase tax, levies, clearance fees, brokerage fees, storage costs, handling fees, or any charges required by authorities or shipping entities in the destination country. These fees are paid separately by the customer.
5.3. The customer undertakes to pay all import charges on time and comply with all regulatory requirements. Delays, non-release, or refusal of shipment due to non-payment, non-compliance, or incorrect information provided by the customer are solely the customer’s responsibility.
5.4. Delays caused by customs procedures, clearance, regulations, inspections, strikes, overload, force majeure, or any external factors beyond the Website’s control will not be considered a breach of delivery timelines.
5.5. Refusal to pay import charges, failure to collect the shipment, returning items voluntarily, providing incorrect details, or any customer-related action resulting in return, storage, destruction, or additional charges will result in the customer bearing all actual costs incurred. These costs may be deducted from any refund the customer may otherwise be entitled to.
Delivery
6.1. Estimated delivery times:
“Now in Stock” items – up to 14 business days
“Home Collection” – up to 14 business days
“Special Designs” – 5–7 weeks
“Custom-Made Orders” – 5–7 weeks
6.2. Delivery times are estimates only and depend on production processes, quality control, seasonal load, and customs clearance. Delays caused by factors outside our control (customs, regulations, shipping disruptions, strikes, factory delays, force majeure) will not be considered a breach. In cases of significant non-delivery, statutory rights to cancellation or refund will be honored.
Cancellations and Returns
7.1. General applicability: Under applicable law, consumers may have the right to cancel remote transactions, subject to returning the product unused and in its original condition and paying any applicable cancellation fees. However, as stated in Section 3.1, for goods manufactured specifically according to the customer’s measurements, requests, or selections—including custom-made wigs—no cancellation due to remorse is permitted. Therefore, the Website does not offer refunds for custom-made items.
7.2. If the Website offers non-custom items, this will be noted on the product page, and statutory cancellation rights will apply, including refund minus lawful cancellation fees, provided the product is returned unused.
7.3. Cancellation due to defect, significant non-conformity, or substantial non-delivery will be made without cancellation fees. DARIA will refund the customer within the legally required timeframe. Customers must notify DARIA of any defect or non-conformity “immediately upon inspection” and no later than 3 calendar days from delivery.
7.4. As a service gesture and without legal obligation, the Website may choose to offer a one-time exchange or cancellation option on certain items. If such an option is offered, it will be stated clearly on the product page.
7.5. When an exchange or cancellation is permitted, the customer must return the item in its original condition and packaging, without any changes such as cutting lace, cutting hair, washing, styling, or altering the wig. Failure to comply disqualifies the customer from exchange or cancellation.
7.6. Exchanges or cancellations do not include shipping costs. To exercise this option, the customer must pay for all shipping fees.
7.7. The “Now in Stock” page offers wigs from existing inventory; therefore, returns and exchanges are permitted for these items.
7.8. To exercise this right, the customer must return the wig exactly as received—without cutting the lace or hair, and including all packaging and accessories.
7.9. The customer must contact customer service and return the item within 3 days of delivery. Only after inspection confirming that the wig was returned as required will a refund be issued, minus shipping fees.

Product Liability
9.1. To the fullest extent permitted by law, DARIA and its owners shall not be liable for any direct, indirect, special, punitive, or consequential damage (including loss of profit or data) arising from use of the Website or the Service, from the purchase or use of wigs or hair products sold on the Website, or from reliance on any content, guides, tips, videos, or images displayed on the Website or brand channels (including Instagram @daria_wigs). Such information is not professional, medical, or cosmetic advice and does not replace personal consultation. Reliance on such information is at the user's own risk.
This exclusion does not limit rights that cannot be waived by law, and in cases where a proven manufacturing defect exists, the provisions relating to repair, replacement, or refund will apply.
Changes to the Website
10.1. The Website may update, add, or remove products, update prices, or modify the Terms of Use at any time without prior notice.
Intellectual Property
11.1. All rights to the Website’s design, content, images, text, and graphic elements are owned by the Website or its licensors.
11.2. No content may be copied, reproduced, distributed, publicly displayed, or used commercially without written permission from the company.
